Le : 31 octobre 2017 - 15h57 (heure de Paris)
Question : To whom it may concern, The contract asks for "supply a certified translation into French, done by a sworn translator, of the technical proposal". Although we have submitted a proposal in English, our proposed staff for the project are native French. Would it not be possible to get them to do the technical translation ? S.

Le : 2 novembre 2017 - 12h26 (heure de Paris)
Rponse : Dear Madam, dear Sir, Mercator Ocean, as specified in the call documents, needs to receive a certified translation. Kind regards, The CMEMS Tenders team

Le : 26 octobre 2017 - 12h51 (heure de Paris)
Question : Dear Sir/Madam, I would like clarification on the procedure to send the application electronically. On page 13 of the Tender Regulations, it says that "Tenderers who have chosen to apply electronically must send a PDF file for each document. Furthermore, all documents must be sent together in a single file, the name of which shall include the name of the contract: 'March 66-SE-CMEMS-CALL2'". Does this mean that all the individual PDFs, corresponding to each individual document, must be combined into ONE global PDF file to be submitted, or can all the individual PDFs be grouped into a zip file, for example? Thank you very much

Le : 26 octobre 2017 - 13h05 (heure de Paris)
Rponse : It means that one document = 1 pdf and all documents are grouped in a folder (instead of file). Please do not zip them there are some problem with zipped folders. An offer can reach 1GO.

Le : 25 octobre 2017 - 10h21 (heure de Paris)
Question : Dear Sir/Madame, with reference to the document "Deed of Commitment", could you please clarify: 1) Do we have to provide a deed of Commitment for each participant (co-contractor)? 2) Point C - Signature of the bid by the applicant: it should be signed by all (by authorised representative of the grouping and by any other co-contractor)? Thanks a lot

Le : 26 octobre 2017 - 13h05 (heure de Paris)
Rponse : 1/ There is only one deed of commitment and all the co-contractors are indicated in part B 2/ The signatures in part C depends on the type of mandate given to the representative. This authorozation is chosen in the application letter co-contractor by ticking a box in F. If you tick the second box then the representative is the only one that signs the deed of Commitment

Le : 24 octobre 2017 - 12h38 (heure de Paris)
Question : Can a PI from an already funded CMEMS project be co-I of a new CMEMS project ?

Le : 26 octobre 2017 - 13h05 (heure de Paris)
Rponse : Yes.

Le : 24 octobre 2017 - 10h38 (heure de Paris)
Question : Dear sir, please confirm the meaning of doc 01_en_Tender_Regulations entry: " Page 10 - $5.3.1 - I - An application letter, for an individual tenderer for tenderers applying alone and an application letter from the co-contractor for each tenderer applying as part of a grouping; dated and signed by a person authorise to enter into a commitment on behalf of the tenderer or the co-contractor. " In case of group application, is interpreted as: - An application letter (as per module 02) dated and signed by a person authorise to enter into a commitment on behalf of the tenderer or the co-contractor - an application letter (as per module 03) from each co-contractor applying as part of a grouping, excluding the representative/principal Thank you, Best regards,

Le : 24 octobre 2017 - 10h38 (heure de Paris)
Rponse : Dear Sir, The application letter module 03 is enough for all the co-contractors of a grouping whether they are authorized representative or not. There is just a paragraph dedicated to the representative and another dedicated to the co-contractors. The co-contractors give mandate to the representative. The representative accepts the mandate. Best regards. The CMEMS Tenders team

Le : 24 octobre 2017 - 10h34 (heure de Paris)
Question : So is just one 03 form for each member. Proceeding from that, I guess that in the representative 03 application, paragraph G (acceptance of the mandate) should be removed. And that subsequent bank details is out of paragraph G, and should be filled by all co-contractors (in their respective application). Is that correct? Another question. Price list has to be attached to Deep of commitment (using the provided form), or delivered separately? One more about doc 13-Price note. This is not listed in Tender regulations, $5.3. How are we supposed to use it? Is it correct that the tenderer group has to produce a single a single Price note (doc 13) indicating the global amount of the offer? Should this be attached to the application? Thank you again, Best regards,

Le : 24 octobre 2017 - 10h34 (heure de Paris)
Rponse : Dear sir, I'm afraid our external translator made some mistakes : you shoul read : "Price list note has to be attached to Deep of commitment." Best regards, The CMEMS Tenders team

Le : 23 octobre 2017 - 10h12 (heure de Paris)
Question : Dear Sir/Madam. Apart from the price note form, filled and signed by authorised representative - do we need to present the breakdown of the price in terms of personnel costs, travel and other costs? Is there a specific form for this, or do we include this in the technical proposal somewhere?

Le : 24 octobre 2017 - 12h00 (heure de Paris)
Rponse : Yes you need to present this information but we did not provide any Template.

Le : 23 octobre 2017 - 08h49 (heure de Paris)
Question : Who will obtain the results property? Can we add a clause for subcontractors?

Le : 23 octobre 2017 - 09h03 (heure de Paris)
Rponse : It is written in the call that European Union will get the property for all deleverables paid. The deliverables are the reports. Mercator Ocan shall agree subcontractors. However, there is no legal link between Mercator Ocan and them. The contactor may negociate anything with them but the property of deliverables as explained above.

Le : 23 octobre 2017 - 08h44 (heure de Paris)
Question : Hox is the project financed? What is the rate? Which of costs are eligible? Do you need timesheets?

Le : 23 octobre 2017 - 09h03 (heure de Paris)
Rponse : Merctaor Ocan proposes a contract service by the mean of public procurement. Nothing else from what is mentioned in the documents will be required (no timesheets). We will choose the best offers without negotiation and pay the price asked (not necessarily equal or inferior to the cost).

Le : 23 octobre 2017 - 08h38 (heure de Paris)
Question : We are a public entity and do not have any turnover, Is-it a problem?

Le : 23 octobre 2017 - 09h03 (heure de Paris)
Rponse : We suggest you replace the turnover by the amount of your budget in the table financial capacities table. Anyway, it doesn't matter if you leave it in blank because for this particular call, the size of the entity is not important.

Le : 20 octobre 2017 - 17h53 (heure de Paris)
Question : On page 12 of document 01, regarding document V the Price note (or list): if the principal has not been authorised by the other members of the grouping to sign the grouping's bid, my understanding is that the application file should include a price note signed by all members of the grouping and a price note per member of the grouping for the services that it shall provide personally, which means N+1 price notes, where N is the number of co-contractors. Is this correct?

Le : 20 octobre 2017 - 17h57 (heure de Paris)
Rponse : No, the application file may include only one price note signed by all members of the grouping. Kind regards, The CMEMS tenders team

Le : 20 octobre 2017 - 17h21 (heure de Paris)
Question : Referring to the template 04 'capacity declaration of the candidates' part E2. Is it mandatory to use exactly the same table with fiscal years as columns? Or is it possible to insert another table showing a list of the main services linked to the aim of the contract for the last 3 years? For example with the columns customer, services and period instead?

Le : 20 octobre 2017 - 17h57 (heure de Paris)
Rponse : Yes, this is possible. Kind regards, The CMEMS tenders team

Le : 20 octobre 2017 - 16h38 (heure de Paris)
Question : In the same regard we would like to ensure that form 4 has to be filled in by the legal representative institution or, on the contrary, must be delivered by each co-contractor.

Le : 20 octobre 2017 - 16h39 (heure de Paris)
Rponse : This form should be filled in by each organisation whether leader of the proposal or co-contractor. Kind regards, The CMEMS Tenders team

Le : 20 octobre 2017 - 16h35 (heure de Paris)
Question : Regarding the call "ACTIVITES DE R&D POUR L'EVOLUTION DU COPERNICUS MARINE SERVICE (CMEMS)", we would appreciate you to confirm whether the "Bank details" part must be, or not, filled in by each co-contractor. If so, should it be completed with the authorised representative's details?

Le : 20 octobre 2017 - 16h39 (heure de Paris)
Rponse : Dear Sir, Each co-contractor should fill in a "Application letter co-contractor grouping" (document 03), which includes a section on bank details and should be signed by the authorised representative. Kind regards, The CMEMS Tenders team

Le : 20 octobre 2017 - 16h31 (heure de Paris)
Question : I am trying to create an account in order to present a tender, but I do not know if I have to create this account as a Non-French company/organization without a SIRET number, or as An Individual person.

Le : 20 octobre 2017 - 16h39 (heure de Paris)
Rponse : It really doesn't matter how you register. There is no impact at all on the call, there is no link between the platform provider and our call. The tool will just indicate us that Mr. x uploaded an offer and this date and hour. Best regards, The CMEMS Tenders team

Le : 20 octobre 2017 - 16h11 (heure de Paris)
Question : Dear Sir/Madam. In a previous question you answered that the proposal COSTs should be excluded VAT. But in the template "Deed of commitment' we are asked to fill in 'Service amount (including tax)'. Is this correct? In previous MERCATOR OCEAN tenders it has been 'excluding tax' I Think. Please advise.

Le : 20 octobre 2017 - 17h57 (heure de Paris)
Rponse : Dear Madam, There is a typo in the document. All prices provided in the documents of the application should be excluding VAT. Kind regards, The CMEMS Tenders team

Le : 20 octobre 2017 - 15h59 (heure de Paris)
Question : Dear Sir/Madam. In table 'E1 - average headcount' of the template 'Capacity declaration of the candidates', should 'Managerial staff' be in absolute numbers or in percent?

Le : 20 octobre 2017 - 16h39 (heure de Paris)
Rponse : Dear Madam, This should be shown as a percentage. Kind regards, The CMEMS Tenders team

Le : 20 octobre 2017 - 15h41 (heure de Paris)
Question : I would like to know if in the part B of the proposal "7. Presentation of the project team (2 pages max. + CVs)" we would include 2 pages of investigator description and the correspondent CVS (with any limit of pages) or a total 2 pages inclunding everything.

Le : 20 octobre 2017 - 15h47 (heure de Paris)
Rponse : The description should be a maximum of 2 pages without the CVs. There is no limit for the CVs. Kind regards, The CMEMS Tenders team

Le : 20 octobre 2017 - 15h12 (heure de Paris)
Question : Dear Sir/Madam. I did not receive an answer for this question dated 19e Oct: If our institute will send an application for 3 of the lots alone, can we use only ONE Individual Application Letter filling in all three lots in Section C_The application is presented for ? And further, can we send only ONE Capacity declaration of the candidates? Or do we need to send ONE Individual Application Letter and Capacity Declaration of the candidates for each lot?

Le : 20 octobre 2017 - 15h47 (heure de Paris)
Rponse : Dear Madam, dear Sir, Each lot will lead to the signature of a separate contract. Therefore you need to provide all requested documents for each lot that you apply to. Kind regards, The CMEMS Tenders team

Le : 20 octobre 2017 - 14h20 (heure de Paris)
Question : We (a UK institute) are subcontractors on a bid to CMEMS Lot 1. We have the choice of either being paid by the lead bidder, or being paid directly by Mercator. Our understanding is that if we are paid directly by Mercator, VAT will be payable by Mercator. More precisely we will have to 'reverse charge' this VAT. This means the VAT is not charged on the invoice, but Mercator's VAT number is displayed on the invoice and a reverse charge statement is made, and Mercator will then have to pay the VAT. Is Mercator prepared to do this?

Le : 20 octobre 2017 - 17h57 (heure de Paris)
Rponse : Yes, this is acceptable to Mercator Ocean. Kind regards, The CMEMS tenders team

Le : 20 octobre 2017 - 12h28 (heure de Paris)
Question : Bonjour.

Cordialement, l'quipe CMEMS Tenders

Le : 20 octobre 2017 - 11h37 (heure de Paris)
Question : Bonjour, Regarding the budget we have some questions. In the presentation of "How to apply" that is uploaded it is mentioned a document called "itemized price" that I could not find in the call forms. Could you confirm us that it is not necessary to provide it in this call? In addition, in the item 8 of the Proposal Guidelines states that the budget "should be detailed and described according to the cost items on the price schedule". Could you tell us where we could find this price schedule? Furthermore, in the section "5.3. Documents required in application" of "Tender regulations" document in the last paragraph of price list part says, "each member of the grouping shall provide a list of prices for the services that it shall provide personally or through a subcontractor(s)". Would this apply to all proposals that are not submitted individually? I think that this point is related to form number 13 "Price note" where only the global amount of the offer is included. Therefore, could you tell us where should we include this information? On the other hand, I wanted to know how the subcontracted equipment is incorporated into the technical proposal. For example, should their CVs be added? Could they be included as work package leaders? How is their cost included? Is their budget included in the subcontracting item of the contracting party's budget or do they have to be broken down as if they were another participant? Thanks in advance.

Le : 24 octobre 2017 - 11h59 (heure de Paris)
Rponse : As you guessed, itemized price is required in most of our calls but it is not needed for this one. There no Template for this "price Schedule" which should be called "price table" (problem of translation between French and English). The operational team confirms that they need for each co-contractor the number of time unit by person, their rate, costs forecasts for travel expenses, publications, and fournitures. Again, problem of translation you should read "price note" instead of price list. The price note is global. The detail by co-contractor is included in the deed of commitment The equipments must be indicated in the capacities dclarations. The Cvs are needed in the proposal. All costs are included in the contractor's budget including the subcontractor's cost.

Le : 20 octobre 2017 - 10h08 (heure de Paris)
Question : Dear Sir/Madam, I have two questions regarding this tender: 1. For tools and equipment (E3 of the Capacity declaration form), do we need to state all our equipment and tools or only those related to the ones we are going to use for this tender? 2. Regarding lot 4: do we need to include in our budgets, the transfer of R&D results towards the CMEMS operational systems? many thanks, best regards Patricia

Le : 24 octobre 2017 - 11h59 (heure de Paris)
Rponse : 1/ This information is useful as soon as it is related to the the tender. 2/ You may include anything you want in your price but please note that the tranfer of property is only for reports.

Le : 20 octobre 2017 - 09h15 (heure de Paris)
Question : Art. 12.2 of the SCC states that advance payments are allowed in accordance with Appendix 1 of SCC (where there is a first prepayment - 20% of the amount indicated in the price note). However in both templates "individual application letter" and "application letter co-contractor", the box "The candidate has requested an advance payment: NO" is pre-filled. Is this a typos or not? Could you please clarify this point? Pre-payments are allowed or not? Merci

Le : 20 octobre 2017 - 15h47 (heure de Paris)
Rponse : Pre-payments (or advance payments) are not possible and the ticked box is not a typo. There also was a mistake in the translation of the title of Annex 1 in the SCC, it should have read schedule payment only (without the word Advance). The first payment will be the 20% indicated in Annex 1 at the beginning of the contract. Kind regards, The CMEMS Tenders team

Le : 19 octobre 2017 - 17h35 (heure de Paris)
Question : Our school would like to apply to the call (lot 5) but we are having trouble drafting the sub-contracting or co-contracting documents. Our researcher would like to benefit from the financial participation of an outside company but our school must abide by public procurement rules. It is not possible to make this subcontract or co-contract appear in the reply documents. Should this company apply separately for the requested amount?

Le : 19 octobre 2017 - 19h00 (heure de Paris)
Rponse : 1/ The first solution would be to approve the subcontract later (during the execution of the contract if you are selected). The only disadvantage is that you cannot take into account the expertise of your subcontractor and it will be considered during the assessment of the proposals. 2/ The second solution is the one you suggest, which means submitting a grouped application, and this company would then be a co-contractor. Kind regards, The CMEMS Tenders team

Le : 19 octobre 2017 - 16h53 (heure de Paris)
Question : Table "E1 - Average headcount" of the template "capacity declaration of the candidates" only presents two fields: "Average annual headcount" and "Managerial staff". Do we have to provide also numbers about "R&D personnel", as requested in the "capacity declaration of sub-contrators" template? Thanks a lot.

Le : 19 octobre 2017 - 19h00 (heure de Paris)
Rponse : Dear Madam, dear Sir, There is a typo in the "capacity declaration of sub-contrators", the information you need to provide is "Average annual headcount" and "Managerial staff". Kind regards, The CMEMS tenders team

Le : 19 octobre 2017 - 16h03 (heure de Paris)
Question : Bonjour, If no access can be provided to the CMEMS model, is the application to a localized model utilizing a different modeling suite acceptable for the aims of this call. The application to another modeling suite would provide evidence of improvements and enhancements through the utilization of the proposed data assimilation scheme and would be compatible with the CMEMS model framework.

Le : 19 octobre 2017 - 19h00 (heure de Paris)
Rponse : Dear Sirs, This is the same question as the previous one, please see our reply below. Kind regards, The CMEMS tenders team

Le : 19 octobre 2017 - 16h01 (heure de Paris)
Question : Good Afternoon, In Relation to Lot 2 of this call we have the following inquiry : As the objective of this lot is to facilitate Data Assimilation with the current CMEMS model which have been identified as a variant of ERSEM, what are the procedures and associated limitations of acquiring this model in order to complete the research in question. A copy of the model or remote access to a compiled and running version of the model would be required in order to then proceed with the data assimilation research. Can you please elaborate on the type of access that can be provided.

Le : 19 octobre 2017 - 19h00 (heure de Paris)
Rponse : Dear Sir, You will need to involve the modelling teams in your project. It is preferrable (but not mandatory) to do it before the project submission. Kind regards, The CMEMS tenders team

Question : If two institutes are submitting one specific different proposal each for the same CMEMS Service Evolution lot, can one of the two institutes (or both) include as "external experts consultant", members of the other institute? As "external expert consultant" I mean a scientist from an external institute that agrees to give advice on the project results and participate in meetings at no cost.

Le : 18 octobre 2017 - 13h03 (heure de Paris)
Rponse : Dear sir or Madam, Mercator Ocan is buying a study for a global price. As soon as your are chosen, and provided that your service complies to the specifications, you can organize yourself as you want to manage it.

Le : 17 octobre 2017 - 15h33 (heure de Paris)
Question : With reference to point 5.3.3 of the Tender Regulations, could you please clarify the instructions to be followed by tenderers applying electronically? Do we have to provide "a PDF file for each document" together with a unique "single file" (not exceeding 4Mb) that includes all the documents? Can this latter be a zip file (named "...March 66-SE-CMEMS-CALL2...") or do we have to provide a big "pdf" collage? Thanks in advance.

Le : 17 octobre 2017 - 18h05 (heure de Paris)
Rponse : Dear Madam, dear Sir, Yes, you should provide a pdf file for each document as they are dispatched internally. The single file can be a zip file, the submission platform will make it automatically after you have uploaded the documents (one by one). Kind regards, The CMEMS Tenders team

Le : 12 octobre 2017 - 16h15 (heure de Paris)

Le : 12 octobre 2017 - 11h44 (heure de Paris)
Question : Dear Madams and Sirs, we would like to apply as co-contractor in lot 5 and have been asked by another institute to take part as a sub-contractor for a second proposal in the same lot. In the special conditions of contract (SCC) I found that 'tenderes may only submit one offer by lot'. Does that statement refer to 'co-contractors' only or would it mean that we can not apply as co-contractor in one proposal and as 'subcontract' in the other proposal? Sincerely, Frank Kauker

Le : 16 octobre 2017 - 18h06 (heure de Paris)
Rponse : Dear Mr Kauker, If one organisation submits as a lead for a lot, it can be included in another offer for the same lot but as a subcontractor only. If you apply as a co-contractor in one offer for a given lot, you can be a subcontractor in another offer. Kind regards, The CMEMS Tenders team

Le : 12 octobre 2017 - 11h00 (heure de Paris)
Question : Are the terms and conditions negotiable as there are a number of clauses that are either not acceptable or there are conflicts between the general and specific conditions?

Le : 16 octobre 2017 - 18h06 (heure de Paris)
Rponse : Dear Mr Thiemert, The terms and conditions are not negotiable. As explained in the French Public Procurement Code, any change to the terms and conditions would be a distortion to competition. In the event of any contradiction or difference between the documents making up the contract, the documents shall apply in accordance with the descending order of importance shown hereafter. - The Deed of commitment, to which the Price list is attached, - these Special Conditions of Contract (SCC) and their Appendices, of which only the original copy held by MERCATOR shall be deemed as authentic, - the Specific Technical Conditions (STC) and their Appendices, of which only the original copy held by MERCATOR shall be deemed as authentic, - The Contract Holder's Proposal and its appendices, - General Conditions of Contract for public contracts for intellectual services (GCC IS approved by the ruling of 16 October 2009. Question : Hello, I note that only one offer per lot is permissable. However, can an offer contain more than one study per lot (as more than one study is foreseen per lot) or is each offer restricted to only one study? Many thanks

Rponse : Dear Mr Thiemert, Offers should be structured according to the proposal guidelines, and should therefore include only one study per lot. Kind regards, The CMEMS Tenders team

Question : Hello, would it be possible to confirm the allocation of funds per Lot? Is there a restriction on the number of proposals an organisation can submit per lot? Is there a requirement for tenders to be joint or can a single organisation submit? Many thanks

Rponse : Dear Mr Thiemert, The overall budget is 3 000 000 euros, for all lots. There is no allocation per lot. Candidates may only submit one offer per lot. Single organisations or groupings can submit an offer. Kind regards, The CMEMS Tenders team
